These Terms of Service ("Terms") govern your use of NourishIQ ("the App"), operated by Premier AI LLC ("Company", "we", "us", or "our").

By downloading, installing, or using NourishIQ you agree to be bound by these Terms. If you do not agree to these Terms do not use the App.

1. Description of Service

NourishIQ is a general wellness application that provides nutrition tracking, meal planning, and AI-powered wellness coaching. The App is designed to support healthy lifestyle choices and general wellness goals.

2. Health and Medical Disclaimer

NourishIQ is a wellness tool, not a medical device or healthcare provider. Always consult a qualified healthcare professional before making significant changes to your diet or health routine.

2.1 Not a Medical Device

NourishIQ is NOT a medical device, medical service, or healthcare provider. The App has not been evaluated or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory authority.

2.2 Not Medical Advice

The information, suggestions, meal plans, nutrition data, and AI coaching provided by NourishIQ are for general wellness and informational purposes only. Nothing in the App constitutes medical advice, diagnosis, treatment, or a substitute for professional medical advice from a qualified healthcare provider.

2.3 Consult Your Doctor

ALWAYS consult a qualified physician, registered dietitian, or other licensed healthcare professional before making significant changes to your diet, exercise routine, or health regimen — especially if you have or suspect you have any medical condition, including but not limited to:

2.4 Nutrient and Calorie Estimates

All calorie counts, macronutrient values, micronutrient estimates, and nutritional information provided by NourishIQ are estimates based on AI analysis and publicly available nutritional databases. These estimates may not be accurate for your specific foods, portion sizes, or preparation methods. Do not rely solely on NourishIQ for precise nutritional information if accuracy is medically important to you.

2.5 AI Coaching Limitations

NourishIQ's AI Coach provides general wellness guidance only. The AI Coach is not a licensed healthcare professional, registered dietitian, certified nutritionist, or medical advisor. Responses from the AI Coach should not be interpreted as professional medical or nutritional advice.

2.6 Assumption of Risk

You acknowledge that use of NourishIQ involves inherent risks and that you assume full responsibility for any decisions you make based on information provided by the App. Premier AI LLC expressly disclaims all liability for any adverse health outcomes, injuries, or damages resulting from your use of or reliance on information provided by NourishIQ.

3. Eligibility

You must be at least 13 years of age to use NourishIQ. Users under 18 should use the App with parental guidance. By using the App you represent that you meet these age requirements.

4.1 Account Registration

You must create an account to use NourishIQ. You agree to provide accurate, current, and complete information and to keep your account information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.3 One Account Per User

You may not create multiple accounts or share your account with others.

5. Subscriptions and Payments

5.1 Subscription Tiers

NourishIQ offers the following subscription options:

5.2 Free Trial

New subscribers receive a 7-day free trial with full access to all features. Your payment method will not be charged during the trial, and will be charged at the end of the trial period unless you cancel before the trial ends.

5.3 Billing

Subscriptions are billed through Apple's App Store. By subscribing you agree to Apple's payment terms. Prices are displayed in your local currency at the time of purchase.

5.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5.5 Price Changes

We reserve the right to change subscription prices with 30 days notice. Continued use after a price change constitutes acceptance of the new price.

All content in NourishIQ including but not limited to text, graphics, logos, recipes, protocols, and software is owned by Premier AI LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Your use of NourishIQ is governed by our Privacy Policy, incorporated herein by reference. By using the App you consent to our data practices as described in the Privacy Policy.

9. Disclaimer of Warranties

We work hard to make NourishIQ accurate, reliable, and genuinely useful for your wellness journey. Like any wellness tool, results may vary based on individual circumstances, health conditions, and how the App is used.

While we strive for accuracy, nutritional estimates are AI-generated and may not be perfect. NourishIQ works best as part of an overall healthy lifestyle and is not a replacement for professional guidance.

To the extent permitted by law, NourishIQ is provided without warranties of merchantability or fitness for a particular purpose. We cannot guarantee uninterrupted service or that the App will be free from errors at all times.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PREMIER AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING BUT NOT LIMITED TO:

These Terms are governed by the laws of the State of Hawaii, United States, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of NourishIQ shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Honolulu, Hawaii, under AAA Commercial Arbitration Rules.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the App after changes constitutes acceptance.
